Placing an order shall be treated as an offer by you to purchase the goods and as acceptance of these Terms and Conditions. Please read them carefully. These terms and conditions do not affect your statutory rights. These terms and conditions are subject to change without prior notice.
The submission of an order and payment thereof, is an offer by you to purchase goods and forms a binding agreement governed by the laws of England and Wales subject to these terms and conditions. We may accept or decline your offer to purchase at our discretion. In the event that we decline, any money paid to us will be returned to you within 7 days in the method by which you placed the order. Goods are subject to availability. We are not liable for any compensation if we do not supply the goods. Ownership of the goods only passes to you when they have been paid for in full. A binding contract is formed when the goods have been dispatched by us.
Please Note: The colours of fabrics and threads are as accurate as possible but may not be exactly as you view them on your computer because of the different ways colour is shown on different monitors. If you wish to colour match a fabric or thread, please send a sample and we will do our best to colour match it for you. If you are unsure about the colour – please contact us first. We cannot be held responsible if you are disappointed in the colour.

We reserve the right to refuse or cancel any order(s) resulting from an error or omission by us. This includes but is not limited to typographical errors. If there is a price increase for any reason, we shall inform you and give you the right to cancel. If an order is sent by mistake, you are responsible for returning that order to us, or to any address we give by the same method in which it was delivered. i.e. if it was sent first class signed for, it must be returned in that way or forwarded to another customer as we request. We will ask permission to exchange addresses. You must obtain proof of postage. Upon delivery to the correct person, a refund for postage will be made to you. We allow 7 days from receipt for you to make the return or forward it as requested. Upon completion, your correct order will be dispatched to you.
Payment for goods on this website must be made using Paypal and includes cheque and card payments through Paypal and must be made in Pounds Sterling, GBP. Payment through Paypal is secure and you do not need to create an account with them to make your payment. It also means that your credit card information is not stored by us. Please note we cannot take credit card orders over the phone. You can send a cheque by post if you prefer, made payable to Karen Platt. Your goods will be dispatched upon clearance of the funds.
Delivery & Postage costs
You can choose the method of delivery by making a selection of available deliveries given on the website including overseas deliveries. We can send orders to any country – if yours is not listed, please contact us for shipping and handling prices BEFORE you order. If for any reason the shipping is not calculated, please contact us BEFORE ordering.
Please allow up to 28 days for delivery, although most goods will be dispatched the same or next day. Part of your order may have to be specially dyed. These times are approximate as delays can occur that are out of our control.
We shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods unless caused by our negligence.
We trust that you will be happy with your order. The UK Distance Selling Regulations provide you with a period in which you can change your mind and cancel your order. Written notice must be given to us within seven working days from the date of receipt of purchase.
You will be wholly responsible for the cost of delivery to you and the safe return of the goods paid by you. Goods must be in pristine condition and be in the original packaging. Refunds (less delivery charges on original order) will be made within 7 days. Do not return items without contacting us first. All returns must be sent by recorded delivery.
Orders are checked by at least two people. If you think there is a shortage in your order or your order is damaged in the post, please contact us within 3 working days of delivery. In the case of damaged goods, please retain all packaging.
IF YOU DO NOT DO THIS WE SHALL HAVE NO LIABILITY FOR GOODS SAID TO BE DAMAGED ON DELIVERY. If the goods returned under this clause are found to be in full working order these will be made available to you for collection.
If the goods you have ordered are out of stock or unavailable then we shall contact you as soon as possible.

3.1 Any Visitor can view the Website, and purchase eCourses on the Website without registering. You need to provide an email address to receive the pdfs. You agree that you will never divulge or share access or your access information to your Learner Account with any third party for any reason.
3.4 You acknowledge that if any information provided by you is untrue, inaccurate, not current or incomplete, we reserve the right to suspend or terminate your access to and use of the Website and your enrolment in Courses.
4. Student Conduct
a) you agree that you will not let anyone else use your eCourse content;
b) will not cheat on any course content, and that all work shall be your own;
6. Licence to use
6.1 Subject to your compliance with these Terms, we grant you a fully revocable, worldwide, non-exclusive, non-transferable, non sub-licensable limited right and licence:

7.1 The Facebook Page you will be invited to when you purchase the eCourse may provide you with the ability to upload discussions, work in progress, finished work and other content and media for social interaction, or certain information and materials in connection withe the Course.
7.2 Copyright is retained by you of such content you upload to Facebook.
7.3. We reserve the right to remove any such content uploaded to Facebook without prior notice at any time and for any reason.
7.4 To the extent that you upload any content to Facebook or online (should this be available), you represent and warrant that:
(a) you have all necessary rights, licences and/or clearances to provide such content and permit us to use and publish such content as provided in paragraph 7.1 to 7.3 above;
(b) such content is accurate and relevant to the Course to the best of your knowledge and belief;
(c) as between you and us, you are responsible for the payment of any third party fees related to the provision, publication and use of such content; and
(d) such use and/or publication of your content does not and will not infringe or misappropriate any third party rights or constitute a fraudulent statement or misrepresentation.
7.5 With respect to uploading any content, you agree to comply with all applicable laws including but not limited to laws regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside.
7.7 You agree to upload only materials related to the subject matter of the eCourse, and you further agree that all such communications by you are subject to and governed by these Terms.
7.8 By using the Facebook page for this eCourse, you agree that:
(a) all communications methods constitute public, and not private, means of communication between you and the other party or parties;
(b) not to include communications sent to or received from third parties
(c) that content will be actively moderated to comply with generally acceptable standards of communication where the following types of language/behaviour is prohibited: swearing, using obscene, offensive or otherwise harmful language, posting defamatory remarks and other types of communication that, in our reasonable opinion, should be prohibited
7.9 You acknowledge and agree that the services set out in paragraphs 7.6 to 7.8 above may be monitored.
8. Copyright Policy
8.1 It is our policy that any content included on the Facebook page that infringes the intellectual property rights of any third party will be removed as soon as possible after we are made aware of such infringement.

11. Your Liability to Us

c. your breach of any of these Terms; and
d. any negligent act or omission, deliberate default or breach of statutory duty on your part.
11.2 In addition, you agree to keep us fully indemnified from and against all actions, claims, demands, costs, expenses, liabilities, loss, damages or other monetary relief brought, made or awarded against or incurred by us resulting (directly or indirectly) from any claims that the content on the Website or Online Content and Courses (or its use) infringe the intellectual property rights of third parties.
11.3 Each indemnity in this paragraph is separate and independent from the other obligations in these Terms. Each of these indemnities is to remain fully effective despite any indulgence granted from time to time and despite any judgment or order.

13. Governing Law
13.1 These Terms and the relationship between you and us are governed by English law.
13.2 For any dispute between you and us, you agree that you will first attempt to resolve it with us informally. In the unlikely event that we are unable to resolve the dispute in this manner within 28 days of the dispute being notified in writing we both agree to submit to the exclusive jurisdiction of the courts of England to resolve any legal matter arising from these Terms and the relationship between you and us.
13.3 Notwithstanding paragraph 13.2, you agree that we are permitted to apply for injunctive remedies (or other types of urgent interim relief) in any jurisdiction at any time.
14. Changes to the Website and these Terms
